Sir,

With reference to my letter dated the 5th April last in which I re­ferred to the indications that the Nicaraguan Government were now prepared to conclude the proposed Trade Agreement with Canada, I have the honour to inform you that the Minister for Foreign Affairs has handed to me for submission to you a modified version of the draft agreement which you origi­nally supplied in 1939. I enclose a copy of the modified version in Spanish together with a translation.†

The Ministry of Foreign Affairs have also handed me the text of another form of preamble which incorporates the names of the plenipotentiaries authorized to sign on behalf of the Nicaraguan and Canadian Governments suggesting that some such form of preamble is necessary. A copy of this form of preamble is enclosed together with a translation.†

I also enclose for your information a Memorandum which I com­municated to the Ministry of Foreign Affairs on the 5th August last re­garding the arrangement proposed whereby the Agreement would enter into force provisionally on the day of its being signed. The draft note which was enclosed with this Memorandum was that enclosed in your letter of the 12th June, 19394

I shall be glad if you will inform me in due course what further steps you wish me to take in the matter.

I am sending a copy of this letter to His Majesty's Principal Secretary of State for Foreign Affairs and to His Majesty's Ambassador at Washington. I am also sending a copy to Mr. M. T. Stewart, Canadian Government Trade Commissioner at Bogota, Colombia.
