AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF IRELAND CONCERNING A WORKING HOLIDAY PROGRAMME OF 8 MAY 2003

 

THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF IRELAND, hereinafter referred to as "the Parties",

WISHING to amend the Memorandum of Understanding between the Government of Canada and the Government of Ireland concerning a Working Holiday Programme (the "MOU"), signed at Dublin on 8 May 2003,

HAVE REACHED the following understanding:

1. The paragraph under the "Responsibilities of the Government of Canada", that reads:

"Successful Irish applicants who possess the aforementioned Letter of Introduction will be issued with an Employment Authorisation on arrival in Canada valid for a period of not more than twelve (12) months from the date of entry without any possibility of extension. When necessary, Irish applicants will be interviewed by representatives of the aforementioned Canadian Immigration Office to determine their eligibility."

will be replaced by:

"Eligible Irish applicants who possess the aforementioned Letter of Introduction at a Canadian port of entry will be issued, without reference to the Canadian labour market situation, a work permit valid for a period of stay that is not more than twenty-four (24) months, provided that they meet all relevant Canadian immigration legislation and regulation, and without restricting the officers' discretionary authority to impose conditions. Eligible Irish applicants will be eligible to receive this work permit on only one occasion, without the possibility of extension.".

2.  The paragraph under the "Responsibilities of the Government of Ireland", that reads:

"The Government of Ireland, through its Embassy and consulates in Canada, will, on application by Canadian citizens, issue free of charge an Employment Authorisation for a period of twelve (12) months from the date of issue, without any possibility of extension, to persons who satisfy each of the following requirements:",

will be replaced by:

"The Government of Ireland, through its Embassy and consulates in Canada, will issue to eligible Canadian applicants, without reference to the Irish labour market situation, an Employment Authorisation valid for a period of stay that is not more than twenty-four (24) months, without the possibility of extension. Eligible Canadian applicants will be eligible to receive this Employment Authorisation on only one occasion, provided that they satisfy each of the following requirements:".

3. Sub-paragraph (i) under the "Responsibilities of the Government of Canada", which reads "are citizens of Ireland resident in Ireland", will be replaced by "are citizens of Ireland".

4. Sub-paragraph (i) under the "Responsibilities of the Government of Ireland", which reads "are citizens of Canada resident in Canada", will be replaced by "are citizens of Canada".

5. All other dispositions of the MOU will remain unchanged.

6. This Amendment will take effect on 1 January 2013 and will remain in effect unless terminated or suspended.
