MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE REPUBLIC OF CROATIA CONCERNING YOUTH MOBILITY

THE GOVERNMENT OF CANADA and THE GOVERNMENT OF THE REPUBLIC OF CROATIA hereinafter referred to as "the Participants",

DESIRING to foster close relations between them;

INTENDING to facilitate access to exchanges that enable youth to gain a better understanding of the other Participant's languages, culture and society through a travel, work and life experience abroad;

INTENDING to encourage youth mobility for the purpose of enhancing the personal and professional development of participating youth;

CONVINCED of the value of facilitating such exchanges;

HAVE COME to the following understanding:

1. PURPOSE

The purpose of this Memorandum of Understanding between the Government of Canada and the Government of the Republic of Croatia concerning Youth Mobility (the "Memorandum") is to simplify and facilitate administrative procedures applicable when citizens who are eligible under this Memorandum intend to enter and remain in the country of the other Participant to improve their knowledge of the other country's languages, culture and society through a travel, work and life experience.

2. CATEGORIES OF ELIGIBLE CITIZENS

The Participants will consider the following Canadian and Croatian citizens to be eligible to benefit from the application of this Memorandum:

  1. Citizens, including post-secondary graduates, who intend to obtain further work experience in the host country under a pre-arranged contract of employment in support of their career development;
  2. Registered students of a post-secondary institution in their home country who intend to fulfill part of their academic curriculum in the host country by completing a pre-arranged work placement, including in the context of an arrangement between post-secondary institutions;
  3. Citizens who intend to travel in the host country and obtain employment to supplement their financial resources.

3. QUALIFYING REQUIREMENTS

  1. The Participants will regard as qualified to benefit from the application of this Memorandum eligible citizens of either country who submit:
    1. For Croatian citizens: an individual application to the Canadian diplomatic mission or consular office responsible for the Republic of Croatia or the country in which they have been lawfully admitted;
    2. For Canadian citizens: an individual application for the approval of temporary residence to the diplomatic mission or consular office of the Republic of Croatia, responsible for Canada or the country in which they have been lawfully admitted;

      Provided they meet the following requirements:

    3. Be between the ages of 18 and 35 inclusive on the date that the application is received by the diplomatic mission or consular office;
    4. Be a Canadian or Croatian citizen holding a valid Canadian or Croatian passport with a validity date exceeding the expected period of stay under this Memorandum;
    5. Be in possession of a return ticket leaving the host country or sufficient financial resources to purchase such a ticket;
    6. Have proof of sufficient financial resources to cover the expenses involved at the beginning of their stay;
    7. Pay the applicable fees to benefit from the application of this Memorandum;
    8. Accept to purchase health care insurance, including hospitalization and repatriation, for the entire authorized period of stay prior to arriving in the host country;
    9. Not be accompanied by dependants in order to benefit from the application of this Memorandum;
    10. As the case may be:
      1. provide proof that they have obtained a pre-arranged contract of employment in the host country in support of their career development; or
      2. provide proof of registration at a post-secondary institution in their home country and that they have obtained a pre­arranged work placement in the host country to fulfill part of their academic curriculum; or
      3. confirm that their intention is to travel in the host country and work to supplement their financial resources.
    11. Meet any other relevant requirements of Canadian and Croatian immigration legislation and regulations, including admissibility, beyond those already set out in subparagraphs (iii) to (x) above.
  2. The Participants will permit qualified citizens to benefit from the application of this Memorandum on a maximum of two (2) occasions. The stays will be discontinuous. The authorized period of each stay will not exceed twelve (12) months.

4. DOCUMENTS FOR ADMISSION AND WORK AUTHORIZATION

  1. Each Participant will use its best efforts to facilitate, under the provisions of this Memorandum, the procedures whereby qualified citizens may enter and remain in its country.
  2. Subject to public interest, public order, national security, immigration and admissibility requirements and public health, the Republic of Croatia will:
    1. issue to qualified Canadian citizens, to whom a valid work permit has been issued by the competent authority of the Republic of Croatia regardless of national labour market conditions, and who have met the conditions required for the approval of temporary residence, a document granting approval to enter and temporarily reside in the Republic of Croatia for a predetermined period. This document will be valid for a maximum of twelve (12) months and will specify the reason for the stay, as defined in paragraph 2 of this Memorandum. The Participants understand that authorization for temporary residence may be entered into the travel document of the qualified Canadian citizen by the relevant Croatian diplomatic mission or consular office or in the event that the Canadian citizen is already in the Republic of Croatia, by the competent police directorate or department;
    2. pursuant to paragraph 2 (ii) or (iii) of this Memorandum, grant to Canadian citizens who have met the conditions required for the approval of temporary residence, a document facilitating admission and temporary residence in the Republic of Croatia, for the entire authorized period of their stay. This document will be valid for a maximum of twelve (12) months and will specify the reason for the stay, as defined in paragraph 2 of this Memorandum. The Participants understand that authorization for temporary residence may be entered into the travel document of the qualified Canadian citizen by the relevant Croatian diplomatic mission or consular office or in the event that the Canadian citizen is already in the Republic of Croatia, by the competent police directorate or department.
  3. Subject to public interest, public order, national security, immigration and admissibility requirements and public health, Canada will:
    1. issue to qualified Croatian citizens, a letter of introduction and, if applicable, a temporary resident visa. This letter will facilitate admission to Canada for a predetermined period, will be valid for twelve (12) months and will specify the reason for the stay, as defined in paragraph 2 of this Memorandum. The Participants understand that the Canadian diplomatic mission or consular office where the application is submitted pursuant to paragraph 3(a) will issue the letter of introduction; and
    2. issue to qualified Croatian citizens who hold a valid letter of introduction, upon their arrival in Canada and without reference to the Canadian labour market situation, a work permit valid for the entire authorized period of their stay, provided that they meet all relevant Canadian immigration legislation and regulations, including the officers' discretionary authority to impose conditions.

5. GENERAL PROVISIONS

  1. Qualified citizens who are benefiting from the application of this Memorandum are subject to the laws and regulations in force in the host country, particularly with regard to employment standards, including wages, working conditions, employment insurance benefits and occupational health and safety. In the case of Canada, the laws and regulations relating to employment standards primarily fall within the jurisdiction of the provinces and territories.
  2. The Participants will encourage relevant organizations on their respective territories to lend their support to the application of this Memorandum particularly by giving advice to qualified citizens so that they can obtain information to facilitate their travel and work experience.

6. IMPLEMENTATION AND CONSULTATIONS

  1. The Participants will set on an annual basis, the maximum number of citizens who will be permitted to benefit from the application of this Memorandum. The number will be determined based on reciprocity and through written exchanges.
  2. The Participants will determine, by mutual consent and through written exchanges, the minimum amount of financial resources required under paragraph 3(a)(vi).
  3. The Participants will count the number of citizens who are benefiting from the application of this Memorandum beginning on the date this Memorandum takes effect to the end of the current year, and then annually from January 1 to December 31.
  4. The Participants will notify each other through written exchanges of all administrative procedures and conditions related to the implementation of this Memorandum.
  5. The Participants may, at any time, consult each other on the interpretation and implementation of this Memorandum.

7. ENTRY INTO EFFECT, AMENDMENTS, SUSPENSION AND TERMINATION

  1. This Memorandum drawn up in duplicate in the English, French and Croatian languages, each version being equally valid, will take effect on the date of signature by the Participants of a Declaration to that effect.
  2. The Participants may amend this Memorandum, in writing, upon their mutual consent.
  3. Either Participant may at any time terminate this Memorandum or temporarily suspend its application in part or in whole by providing written notification to the other Participant through diplomatic channels. Termination or suspension of this Memorandum will take effect at least 30 days following the date of the notification and will not affect the eligibility to enter of persons who hold a valid entry document pursuant to paragraph 4 and persons already admitted under the terms of this Memorandum.

 

DECLARATION -DÉCLARATION -IZJAVA

WE THE UNDERSIGNED DECLARE:
Upon the signature of this Declaration, the Memorandum of Understanding between the Government of Canada and the Government of the Republic of Croatia concerning Youth Mobility, attached to and integral part of this Declaration will come into effect according to its terms.
