Below is brief information on recent disputes in which Canada has been involved as a complainant, respondent or third party. Canada as Complainant

European Communities – Measures Prohibiting the Importation and Marketing of Seal Products (DS400)

Background: This dispute concerns restrictions imposed by the European Union on the import and sale of seal products.

Status and WTO Documents: The Appellate Body ruled in May 2014 that the measures violated WTO obligations. The EU notified its intent to implement the rulings and recommendations of the DSB in July 2014. See WTO webpage DS400 for more details.

United States – Certain Country of Origin Labeling (COOL) Requirements (DS384)

Background: This dispute concerns the United States’ different labeling requirements for beef and pork based on where the animals used to produce the meat were born, raised and slaughtered.

Status and WTO Documents: The Appellate Body ruled in June 2012 that the measures violated WTO obligations. Compliance proceedings were launched September 2013, and are ongoing. See WTO webpage DS384 for more details.

Canada as Respondent

Canada — Anti-Dumping Measures on Imports of Certain Carbon Steel Welded Pipe from The Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (DS482) (Chinese Taipei as complainant)

Background: This dispute concerns the provisional and definitive anti-dumping measures imposed by Canada on imports of certain carbon steel welded pipe (CSWP) originating in, among others, Chinese Taipei.

Canada – Certain Measures Affecting the Renewable Energy Generation Sector (DS412) (Japan as complainant)

Canada – Measures Relating to the Feed-in Tariff Program (DS426) (European Union as complainant)

Background: This dispute concerns the purchase of renewable electricity under the Province of Ontario's Green Energy Feed-in Tariff Program.

Status and WTO Documents: The Appellate Body ruled in May 2013 that the measures violated WTO obligations. Canada notified its implementation of the recommendations and rulings of the DSB in June 2014. See WTO webpages DS412 and DS426 for more details.

Background: This dispute concerns certain measures Indonesia imposes on the importation of horticultural products, animals and animal products.

Background: This dispute concerns the use of certain methodologies in US anti-dumping investigations involving Chinese products.

US – Anti-dumping and Countervailing Measures on Large Residential Washers from Korea (DS464) (Korea as complainant)

Background: This dispute concerns US anti‑dumping and countervailing measures relating to large residential washers from Korea.

Status and WTO Documents: A Panel was composed June 2014. Timelines and working procedures are forthcoming. See WTO webpage DS464 for more details.

India – Certain Measures Relating to Solar Cells and Solar Modules (DS456) (United States as complainant)

Background: This dispute concerns certain measures India imposes relating to domestic content requirements under the Jawaharlal Nehru National Solar Mission (“NSM”) for solar cells and solar modules.

United States — Countervailing and Anti-dumping Measures on Certain Products from China (DS449) (China as complainant)

Background: This dispute concerns countervailing and anti-dumping duties imposed by the United States on certain products imported from China.

Argentina – Importation of Goods (DS438) (EU as complainant) (DS444) (US as complainant) and DS445 (Japan as complainant)

Background: This dispute concerns certain measures imposed by Argentina on the importation of goods.

United States — Countervailing Duty Measures on Certain Products from China (DS437) (China as complainant)

Background: This dispute concerns the imposition of duties against various Chinese products in 17 different US countervailing duty investigations.

United States — Countervailing Measures on Certain Hot-Rolled Carbon Steel Flat Products from India (DS436) (India as complainant)

Background: This dispute concerns the imposition of countervailing duties by the United States on steel products from India.

Australia – Plain Packaging (DS434) (Ukraine as complainant) (DS435) (Honduras as complainant) (DS441) (Dominican Republic as complainant) (DS458) (Cuba as complainant) and (DS467) (Indonesia as complainant)

Background: This dispute concerns certain Australian laws and regulations that impose trademark restrictions and other plain packaging requirements on tobacco products and packaging.

China – Measures Related to the Exportation of Rare Earths, Tungsten and Molybdenum (United States, European Union, and Japan as complainants) (DS431, DS432 and DS433)

Background: This dispute concerns Chinese restrictions and charges on the export of certain minerals.

China – Measures Related to the Exportation of Various Raw Materials (DS394, DS395 and DS398) (United States, European Communities, and Mexico as complainants)

Background: This dispute concerns Chinese restrictions and charges on the export of various raw materials.

Status and WTO Documents: The Appellate Body ruled in January 2012 that the measures violated WTO obligations. Compliance processes are ongoing. See WTO webpages DS394, DS395 and DS398 for more details.

United States – Measures Concerning the Importation, Marketing and Sale of Tuna and Tuna Products (DS381) (Mexico as complainant)

Background: This dispute concerns measures imposed by the United States that establish conditions for using a "dolphin-safe" label on tuna products based on fishing method and area of harvest.

Status and WTO Documents: The Appellate Body ruled in May 2012 that the measures violated WTO obligations. A Compliance Panel was established in January 2014. Proceedings are ongoing.. See WTO webpage DS381 for more details.

United States – Definitive Anti-Dumping and Countervailing Duties on Certain Products from China (DS379) (China as complainant)

Background: This dispute concerns anti-dumping and countervailing duties imposed by the United States on certain products from China.

United States – Measures Affecting Trade in Large Civil Aircraft – Second Complaint (DS353) (European Communities as complainant)

Background: This dispute concerns subsidies provided by the United States to Boeing.

European Communities – Measures Affecting Trade in Large Civil Aircraft (DS316) (United States as complainant)

Background: This dispute concerns subsidies provided by the European Union to Airbus.
