Accountability: Global Affairs Canada
The Avoiding Complicity in Mistreatment by Foreign Entities Act (ACMFEA) and its associated directions seek to prevent the mistreatment of any individual as a result of information exchanged between a Government of Canada department and a foreign entity.
The ACMFEA, which came into force in July 2019, codifies and enshrines Canada’s commitments in respect to the Canadian Charter of Rights and Freedoms, and Canada’s international legal obligations on prohibiting torture and other cruel and inhumane treatment. In September 2019, pursuant to section 3 of the ACMFEA, the Governor in Council (GiC) issued written Order in Council Directions (OiC) to the Deputy Head of Foreign Affairs.
Since they are entrenched into law, the OIC Directions for ACMFEA supersede the Ministerial Direction (MD) on Avoiding Complicity in Mistreatment by Foreign Entities, that preceded them.
